Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of www.pristinefiltration.com.au (the “Site”) and the purchase of any products from Pristine Filtration.

The Site is owned and operated by Freedom Legacy Pty Ltd (ABN [31 665 854 848) trading as Pristine Filtration (“Pristine Filtration”, “we”, “us”, “our”).

By accessing our Site, requesting a quote, purchasing a Product, or engaging with our services, you agree to be bound by these Terms, together with our Privacy Policy and Refunds, Returns & Warranty Policy.

If you do not agree, you must not use this Site or purchase from us.

1. Definitions

Customer / You means any person accessing the Site or purchasing Products.

Products means water filtration systems, accessories, cartridges, components and related goods supplied by us.

Finance Provider means any third-party finance partner including (but not limited to) Zip, Brighte or similar providers.

Installer means any licensed plumber or tradesperson engaged to install the Products.

2. Eligibility

You must:

• Be at least 18 years old
• Have legal capacity to enter into a binding agreement
• Provide accurate and complete information
• Ensure installation is completed by a licensed plumber

3. Orders, Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.

We reserve the right to:

• Correct pricing or description errors
• Refuse or cancel orders
• Limit quantities
• Update product specifications

Orders are not binding until accepted by us and payment is received (or finance approved).

If finance is selected, your finance contract is solely with the Finance Provider.

4. Supply-Only Model & Installation Responsibility

Unless expressly agreed in writing, all Products are supplied on a supply-only basis.

We do not provide plumbing services.

You are solely responsible for:

• Engaging a licensed plumber
• Ensuring installation complies with Australian plumbing standards
• Confirming compatibility with your property

We are not liable for:

• Incorrect installation
• Water leaks or flooding
• Property damage
• Non-compliant plumbing
• Consequential loss arising from installation

Installation-related claims must be directed to your Installer.

5. Delivery & Risk

Delivery timeframes are estimates only.

Risk passes to you:

• Upon delivery to your nominated address; or
• When the Products leave our premises/supplier if you arrange freight.

We are not liable for courier delays or supply chain interruptions beyond our reasonable control.

6. Australian Consumer Law

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

Nothing in these Terms excludes or limits your statutory rights.

Where permitted by law, our liability is limited (at our option) to:

• Repair
• Replacement
• Refund

7. Manufacturer Warranty

Eligible systems include a 5-year manufacturing warranty against defects in materials and workmanship.

This does not cover:

• Filter cartridges or consumables
• O-rings, seals, replaceable components
• Normal wear and tear
• Cosmetic damage or corrosion
• Misuse or neglect
• Damage from improper installation

Proof of purchase and licensed installation may be required.

8. Returns & Refunds

Returns and refunds are governed by our Refunds, Returns & Warranty Policy.

We do not accept change-of-mind returns.

Approved refunds are processed to the original payment method.

Finance refunds are processed via the Finance Provider.

9. Finance Terms

Finance approval is subject to the Finance Provider’s assessment.

We are not responsible for:

• Approval decisions
• Repayment schedules
• Fees or interest
• Account disputes

All finance disputes must be directed to the provider.

10. Marketing, SMS & Communication Consent

By submitting your details through our website, social media advertisements, enquiry forms, or water report request forms, you expressly consent to being contacted by Pristine Filtration via:

• Phone call
• SMS (text message)
• Email
• Automated marketing platforms

Communications may include:

• Delivery of your requested water report
• System recommendations
• Appointment scheduling
• Follow-up communications
• Promotional offers

You acknowledge that your information may be processed through secure third-party platforms including (but not limited to):

• Meta (Facebook & Instagram)
• Google
• Mailchimp
• Mandrill
• CRM and SMS platforms

Standard SMS carrier rates may apply.

You may opt out of marketing communications at any time via unsubscribe links, replying STOP (where available), or contacting us directly.

Transactional communications (orders, warranties, confirmations) may still be sent.

11. Advertising & Lead Forms

If you submit information via Meta (Facebook/Instagram) lead forms or digital advertising:

• You consent to follow-up contact
• Your data may be transferred to our CRM and marketing systems
• You may be included in remarketing audiences

You can manage ad preferences directly through Meta or Google settings.

12. Water Report Disclaimer

Water reports provided via postcode tools or enquiry forms are based on publicly available supply data and regional infrastructure mapping.

They:

• Are general in nature
• May not reflect property-specific plumbing conditions
• Do not constitute laboratory analysis
• Should not be relied upon as medical advice

For precise contaminant analysis, independent laboratory testing is recommended.

13. Intellectual Property

All Site content including:

• Logos
• Branding
• System designs
• Images
• Reports
• Written materials

is the property of Freedom Legacy Pty Ltd or its licensors.

Unauthorised reproduction is prohibited.

14. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for:

• Indirect or consequential loss
• Water damage
• Flood damage
• Property damage
• Business interruption
• Loss of profits
• Installation errors

Our total liability is limited to the purchase price of the Product.

Nothing limits your ACL rights.

15. Indemnity

You agree to indemnify and hold harmless Freedom Legacy Pty Ltd from claims arising from:

• Breach of these Terms
• Improper installation
• Use contrary to manufacturer instructions
• Use of an unlicensed Installer

16. Privacy

Your personal information is handled in accordance with our Privacy Policy.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.

You submit to the exclusive jurisdiction of the courts of Queensland.

18. Severability

If any provision is unenforceable, the remainder remains valid.

19. Amendments

We may update these Terms from time to time. Continued use constitutes acceptance.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Pristine Filtration.
